COOKIES NOTIFICATION

  1. APPLICABLE REGULATIONS

The second section of article 22 of Law 34/2002, 11 July, of information and electronic commerce services (LSSI-CE from now on) states that:

  1. Service providers may use data devices for storing and retrieving data storage and retrieval devices in the recipients’ terminals on the condition that they have given their consent after they have been given clear and complete information on their use, especially on the purposes of the data processing, in accordance with Organic Law 15/1999, 13 December, on the protection of personal data.

When technically possible and effective, the recipient’s consent for accepting the processing of the data may be provided through the use of suitable parameters in the browser or other applications as long as this is configured during its installation or updating with a specific action for the purpose.

The above will not impede the possible technical storage or access for the sole purpose of transmitting a communication via an electronic communications network or, as far as is strictly necessary, to provide an information society service specifically requested by the recipient.

According to the “Guide to the use of cookies” published by the Spanish Data Protection Agency (AEPD from now on) in 2013, the LSSI-CE is applicable to any type of file or device downloaded to a user’s terminal for the purpose of storing data that may be updated and retrieved by the organisation responsible for its installation. Cookies are one of these generally-used devices so that from now on we will call these devices generically cookies.

Cookie used for any of the following purposes are exempt from complying with the obligations set in article 22.2 of the LSSI-CE:

 

  1. TYPES OF COOKIES ACCORDING TO THEIR PURPOSE

A cookie is a file downloaded to your computer when you access certain Web sites. Among other things, cookies allow a Web site to store and retrieve information on a user’s browsing habits or of his/her equipment and, depending on the information they contain and the way in which you use your equipment, may be used to recognise the user.

As stated in the AEPD’s “Guide to the use of cookies,” there are various types of cookies according to the use of the data obtained with them:

 

  1. INFORMATION PRINCIPLE

In compliance with article 5 of Organic Law 15/1999, 13 December, on the protection of personal data (LOPD from now on), you ae specifically, precisely and unambiguously informed that cookies installed in your computer will be used for the following purposes.

PHPSESSID Record the authentication of users on the Web site. When a user fills in a form or starts a session on the site as a registered user.
catAccCookies Manage the user’s acceptance of cookies. During access to the Web site.

 

The recipients of the information obtained with the cookies installed in your computer will be the following organisations:

 

  1. PRINCIPLE OF CONSENT

Consent for the installation of cookies will be understood as given after selecting the Accept button on the pop-up panel at the bottom of the screen.

Where users do not specifically state whether or not they accept the installation of cookies but continue to use the Web site or application, it will be understood that they have given their consent, with our organisation specifically informing them of the possibility of blocking or deleting the cookies installed in their equipment using the configuration options in the browser installed in their computer.

 

  1. COOKIES INSTALLATION OPTION

Although the acceptance of the installation of cookies in your computer is optional for you, refusing their installation could mean that the functionality of the Web site is limited or impossible, which will make the provision of services by our organisation through it impossible.

  1. DATA SECURITY PRINCIPLE

HOTEL PARQUE TROPICAL undertakes to comply with its secrecy obligation regarding the personal data and its duty to keep them and take all technical and organisational measures necessary to guarantee the security of personal data and prevent their unauthorised alteration, loss, treatment or access, taking into account the state of the technology, the nature of the data stored and the risks to which they are exposed, whether through human action or from the physical or natural medium, described in Title VIII of Royal Decree 1720/2007, 21 December, approving the regulations arising from Organic Law 15/1999, 13 December, on the protection of personal data.
 

  1. EXERCISING OF RIGHTS

In compliance with the LOPD and Royal Decree 1720/2007, 21 December, approving its regulations, recipients of the service may at any time exercise their rights of access, correction, cancellation and opposition with the organisation responsible for the file or processing, attaching a photocopy of his/her identity card.
